MARJAC Avocats is a Luxembourg law firm organised under the form of a Société à responsabilité limitée with registered office at 21, rue Glesener, L-1631 Luxembourg, Grand Duchy of Luxembourg, registered with the Registre de commerce et des Socétés, Luxembourg under number B 238609 and with the Luxembourg Bar under List V (MARJAC or we or us).

It is the priority of MARJAC to seek to protect your privacy and secure the saving of your personal data.

MARJAC's processing of personnal data is conducted in accordance with the rules of the General Data Protection Regulation of the European Regulation 2016/679 (GDPR) that aims to protect individuals' privacy in connection with the processing personnal data. 

This privacy policy intends to explain how we collect, process and share your data (you being the data subject) and conducts its business;

From who do we collect information?

We collect information from you when you are interacting with us as :

  • a client or representative of a client who is contacting us and for which we have issued an engagement letter

  • a third party that interacts with us in the context of a particular file at the request of a client

  • a person that is a service provider or a supplier to us

  • a public authority with whom we interact in the context of a particular file or for our own organisational purposes

  • a person who has agreed to be entered into our marketing mailing list for the purpose of receiving invitations, newsletters or any other type of marketing material

  • a person that applies for a position within MARJAC or is contacting us for the purpose of being employed, to offer services or to obtain information from us   

What type of personnel data do we collect ?

Marjac processes the following types of personal data about you :

  • contact information (e.g. name, surname, professional and personal addresses, email and telephone number)

  • identification information and AML/KYC documentation collected to allow us to identify you as beneficial owner or to identify your beneficial owner if applicable and to comply with our AML/KYC obligations (like date and place of birth, nationality, copy of ID card or passport, gender, copy of criminal records, job function, organisation, source of funds, background informationmation)

  • professional information (e.g. job function, identity of your employer, job title, department, organisation name, size and location)

  • financial information e.g. bank and count details)

  • information provided in the course to the provision of legal and corporate services for example information on professional relationships and background, financial wealth and assets held, transactions entered into, legal advice given (and any actions taken as a result of such advice), tax status, disputes and court proceedings engaged

  • information provided to us in respect of an application for, or expression interest in, a job with MARJCA such as personal information relating to your education and employment history, any professional qualifications, your nationality, your immigration, right to work or residential status. We may also collect information from third parties in this regard. This may include information such as references, or background checks provided by agencies such as credit reference agencies. In addition, we may also obtain information about you form public sources, such as information on social media accounts

  • any other personal data provided to MARJAC and allowing us to perform our legal and contractual duties

When do we collect information? 

MARJAC  is collecting personal data when :

  • you contact us for legal advice or information

  • you contact us for job application

  • a third party provides us with your details when it is legally permitted to do so

  • we meet each other and/or enter into relationship

Purpose and legal grounds for processing personal data 

In order for MARJAC to process your personal data in compliance with applicable laws and regulations, the application of the rules of GDPR has been determined as the legal basis to protect your personal data.

MARJAC processes your personal data for the following purposes and based on the following legal grounds :

  • to provide you with the services requested

  • to provide you with information, portal access or any type of services and information

  • to deal with information proved by you in the context of a particular file following a request from us

    • processing is necessary for the performance of a contract to which the data subject is a party or ignorer to take steps at the request the data subject before entering into a contract

  • to comply with applicable laws and regulations, in particular to fulfil our duties as a Luxembourg law firm under applicable AML/KYC rules 

    • processing is necessary for compliance with a legal obligation to which we are subject

  • to process clients related claims

    • processing is necessary for the purpose of the legitimate interest pursued by us

  • to maintain and update our list of contacts

  • to manage our relationships with you

  • to send you newsletters, communications, updates, briefings, invitations to events

    • processing is necessary for the performance of a contact to which you are a party

    • processing is necessary for the purpose of the legitimate interests pursued by us

  • to carry out recruitment process

    • processing is necessary for the performance of a contract to which you are a party or in order to take steps at your request before entering into a contract

  • to comply with any applicable rules, laws and regulations, code of practices, guidelines, recommandations or to assist in law enforcement and investigations from public authorities

Protection and transfer of personal data

MARJAC has taken the appropriate technical security and organisational measures to protect the personal data from loss, abuse and unauthorised access.

MARJAC does not sell, rent or make any profit with the use of your personal data.

MARJAC may transfer your personal data to third parties like correspondents, notaries, trade register, service providers, banks... with your specific consent only.

Website may use cookies to personalize and facilitate maximum navigation of the User by this site. The User may configure his / her browser to notify and reject the installation of the cookies sent by us.

Retention period

Personal data will be retained :

  • for a period deemed necessary to the purpose for which it was intended

  • for the purpose of performing our obligations under a contract with you

After this period, we will erase your personal data.

Rights and remedies 

You have the right :

  • to request information on how your personal data is processed and what personal data is processed about you

  • to receive a copy of the personal data that is being processed

  • to request to have your personal data corrected or erased

  • to request restriction of processing when it is based on other legal grounds

  • to have your personal data transmitted to another person.

If you think that your personal data is processed wrongly, you are entitled to lodge a complaint with the supervisory authority, the Commission Nationale pour la Protection des Données (the CNPD)

Notification of breach

MARJAC will notify the CNPD in case of breach of personal data protection no later 72 hours after detecting the breach.

Pursuant to the provisions of GDPR, clients and contacts will be notified of a personal data breach without undue delay only when the personal data breach is likely to result in a high risk to their rights and freedoms.

Changes to this policy

MARJAC may decide, at its own discretion, to change this policy in order to ensure its accuracy, completeness and up-to-date status.

MARJAC encourages you to review this policy periodically to remain informed about your rights and how we are processing your personal data.
