MARJAC Avocats is a Luxembourg law firm organised under the form of a Société à responsabilité limitée with registered office at 2, Place de Paris, L-2314 Luxembourg, Grand Duchy of Luxembourg, registered with the Registre de commerce et des Socétés, Luxembourg under number B 238609 and with the Luxembourg Bar under List V (MARJAC or we or us), and with the VAT number LU31613608.

It is the priority of MARJAC to seek to protect your privacy and secure the saving of your personal data.

MARJAC‘s processing of personnal data is conducted in accordance with the rules of the General Data Protection Regulation of the European Regulation 2016/679 (GDPR) that aims to protect individuals’ privacy in connection with the processing personnal data.

From who do we collect information?

We collect information from you when you are interacting with us as :

a client or representative of a client who is contacting us and for which we have issued an engagement letter

Marjac processes the following types of personal data about you :

contact information (e.g. name, surname, professional and personal addresses, email and telephone number)
identification information and AML/KYC documentation collected to allow us to identify you as beneficial owner or to identify your beneficial owner if applicable and to comply with our AML/KYC obligations (like date and place of birth, nationality, copy of ID card or passport, gender, copy of criminal records, job function, organisation, source of funds, background informationmation)
professional information (e.g. job function, identity of your employer, job title, department, organisation name, size and location)
financial information e.g. bank and count details)
information provided in the course to the provision of legal and corporate services for example information on professional relationships and background, financial wealth and assets held, transactions entered into, legal advice given (and any actions taken as a result of such advice), tax status, disputes and court proceedings engaged
information provided to us in respect of an application for, or expression interest in, a job with MARJCA such as personal information relating to your education and employment history, any professional qualifications, your nationality, your immigration, right to work or residential status. We may also collect information from third parties in this regard. This may include information such as references, or background checks provided by agencies such as credit reference agencies. In addition, we may also obtain information about you form public sources, such as information on social media accounts
any other personal data provided to MARJAC and allowing us to perform our legal and contractual duties

MARJAC is collecting personal data when :

you contact us for legal advice or information
you contact us for job application
a third party provides us with your details when it is legally permitted to do so
we meet each other and/or enter into relationship

Purpose and legal grounds for processing personal data

In order for MARJAC to process your personal data in compliance with applicable laws and regulations, the application of the rules of GDPR has been determined as the legal basis to protect your personal data.

Protection and transfer of personal data

MARJAC has taken the appropriate technical security and organisational measures to protect the personal data from loss, abuse and unauthorised access.

MARJAC does not sell, rent or make any profit with the use of your personal data.

MARJAC may transfer your personal data to third parties like correspondents, notaries, trade register, service providers, banks… with your specific consent only.

Retention period

Personal data will be retained :

for a period deemed necessary to the purpose for which it was intended
for the purpose of performing our obligations under a contract with you
for as long as required or permitted by law.

After this period, we will erase your personal data.

Rights and remedies

You have the right :

to request information on how your personal data is processed and what personal data is processed about you
to receive a copy of the personal data that is being processed
to request to have your personal data corrected or erased
to request restriction of processing when it is based on other legal grounds

If you think that your personal data is processed wrongly, you are entitled to lodge a complaint with the supervisory authority, the Commission Nationale pour la Protection des Données (the CNPD)

Notification of breach

MARJAC will notify the CNPD in case of breach of personal data protection no later 72 hours after detecting the breach.

Pursuant to the provisions of GDPR, clients and contacts will be notified of a personal data breach without undue delay only when the personal data breach is likely to result in a high risk to their rights and freedoms.

Changes to this policy

MARJAC may decide, at its own discretion, to change this policy in order to ensure its accuracy, completeness and up-to-date status.
